ARC Application and Review Procedures

Application

A written application must be submitted by a lot owner to the ARC for approval for all lot improvements or modifications prior to the start of any site work.  

Exempt from the approval process are:

  • Interior modifications
  • Landscaping  
  • Repainting or reroofing in the existing color (if it was previously approved)

Definitions:

  • Written application – includes electronic submissions.
  • Submitted – Application must include all required information and applicable fees before it is considered submitted. 
  • Lot owner – Current owner of a lot located in Sorrento Skies who is in full compliance with the terms and provisions of the covenants and restrictions.
  • ARC – Architectural Review Committee or its agent.
  • Improvements or modifications – any visible change to a property.  Examples include new construction, exterior home modifications, additions of lighting, driveway modifications, fencing and other hardscape.  
  • Site work – includes land clearing, excavation, and grading. 

Approvals

Written approval must be obtained from the ARC in order for the project to begin.  The ARC shall have the absolute and exclusive right to disapprove any plans, specifications or details submitted
.

Reasons for disapproval:

  • the request is not in accordance with any of the provisions of the Declarations of Restrictions and the guidelines; 
  • the design, color scheme or location upon the lot or lots of the proposed improvements are not in harmony with the general surroundings or adjacent structures; 
  • if the plans or specifications submitted are incomplete; 
  • the ARC deems the plans, specifications or detail, or any part thereof, to be contrary to the best interests, welfare or rights of all or any part of the real property within Sorrento Skies or its owners.

The ARC and its agents shall not, in any way, be responsible for any defects in plans, specifications or details submitted, revised or approved in accordance with the provisions contained herein or in the guidelines, nor for any structural or other defect in any construction. 

Approval Period

The ARC shall approve or disapprove plans within 21 days of submission.

  • Changes in accordance with ARC recommendations may be resubmitted for determination by the ARC, in which case the ARC shall have an additional 21 days from receipt of the resubmitted plans and specifications to approve or disapprove said resubmitted plans and specifications. 
  • In the event that the ARC fails to approve or disapprove plans, within 21 days from receipt of the same by the ARC, approval shall be deemed to have been given by the ARC. 

Appeal of disapproval

Within 20 days of written disapproval by the ARC, a lot owner may appeal the disapproval to the Board of Directors whose decision will be final.

Project timing

The POA allows a maximum of two (2) years for new construction projects and one (1) year for modifications to be completed.

  • Additional time for cause may be requested.  
  • Projects not completed within the approved time frame will be turned over to the Board and may be subject to Board action.
  • Projects not started within the allowed time frame will be deemed to have been abandoned and are no longer approved.

Final staked build site for new homes requires on-site approval and sign-off by ARC 

Project completion

The ARC will issue a Certificate of Completion to the owner upon completion of the project according to plans submitted.

The ARC, or its agent, shall have the right to inspect all projects to ensure that it is performed in strict accordance with the approved plans, specifications and details.
